1. Introduction and Acceptance of Terms

Welcome to Nano Banana Video ("Nano Banana Video," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our AI video generation service available at nano-banana.video (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Nano Banana Video provides AI-powered video generation, including text-to-video creation and image-to-video generation. Outputs may vary based on inputs, model behavior, and system conditions.

3. Eligibility and User Accounts

Eligibility: You must be at least 13 years old to use the Service.
Account Creation: To use core features, you may need to create an account and provide accurate information.
Account Security: You are responsible for maintaining the confidentiality of your credentials and all activity under your account. Notify us promptly if you suspect unauthorized access.

4. Subscription Plans and Credits

4.1 Credit System

The Service uses a credit-based system: 1 credit = 1 second of video without sound; 2 credits = 1 second of video with sound.
A 5-second video without sound costs 5 credits; a 10-second video with sound costs 20 credits.
A paid subscription is required to generate videos. There is no free tier.
Paid subscribers receive monthly credit allocations as shown on the pricing page.

4.2 Allocation and Expiration

For monthly subscriptions: credits are allocated at the start of each billing period.
For annual subscriptions: credits are allocated monthly (not all at once), even though you are billed annually.
Unused credits do not roll over and expire at the end of each monthly cycle.
Credits are non-refundable, non-transferable, and have no cash value.

4.3 Usage Limits and Fair Use

We enforce usage limits to protect service stability and prevent abuse:

Concurrency limit: 1 concurrent generation per user.
Failed generations: If a generation fails due to a system error, we will automatically restore the credits used for that request.

We may adjust these limits, credit rules, or plan benefits with reasonable notice by updating the pricing page or in-product messaging.

4.4 Video Output

All videos are generated in HD resolution.
Optional AI-generated sound (dialogue, sound effects, ambient audio) is available for all plans.

4.5 Downloading and Export

You may download generated video files (MP4) for your personal or commercial use, subject to the restrictions in these Terms. Commercial use requires a Pro or Max subscription. Basic plan is for personal use only.

5. Pricing, Payments, and Taxes

Payments are processed by PayPal and Creem.
Prices are shown in USD.
You authorize us (and our payment processors) to charge applicable fees for your selected plan, including recurring charges until cancellation.
You are responsible for any applicable taxes, duties, or similar governmental assessments.
Prices are subject to change with reasonable notice to users.

6. Cancellation and Refund Policy

6.1 Cancellation

You may cancel your subscription at any time through your account settings.
Upon cancellation, you retain access to the Service until the end of your current billing period.
After cancellation takes effect, your monthly credit allocation will stop and any remaining credits will expire.

6.2 Refunds

Subscriptions are generally non-refundable once a billing period has begun.
We do not provide refunds for unused credits within a billing period.
Failed generations: If a generation fails due to a system error, we will automatically restore the credits consumed for that request. This is not a monetary refund.
Exceptional circumstances: In rare cases, refunds may be considered at our sole discretion on a case-by-case basis. Any such refund does not create an obligation for future refunds.

7. Your Content and Generated Outputs

7.1 Your Responsibilities

You are responsible for:

The text prompts and reference images you submit
Ensuring you have the necessary rights/permissions to use that input
How you use the generated outputs

Do not use the Service to violate any law or any third-party rights (including copyright, trademark, privacy, publicity/personality rights, or other proprietary rights).

7.2 Ownership / Rights in Outputs

As between you and us, you retain your rights in your inputs. Subject to these Terms and applicable law, you may use generated video outputs for personal or commercial purposes (commercial use requires a Pro or Max subscription).

Important: This does not grant you rights to use content that infringes others' rights (e.g., unauthorized reproduction of copyrighted works, generating content that violates third-party copyrights or trademarks, etc.).

7.3 License to Operate the Service

You grant us a limited, worldwide, non-exclusive license to host, process, transmit, store, and display your inputs and generated outputs solely to provide, maintain, secure, and improve the Service, including:

Generating videos and delivering results
Providing generation history features
Enforcing usage limits and preventing abuse
Troubleshooting and customer support

8. NSFW and Explicit Content Policy

Users are strictly prohibited from generating, uploading, or distributing any NSFW (Not Safe For Work) or sexually explicit content using this platform. This includes but is not limited to nudity, pornographic material, sexual acts, or any other adult content, regardless of whether minors are involved or not. Violation of this policy may result in immediate account termination.

9. Prohibited Activities

You agree not to use the Service to generate, upload, distribute, or facilitate content that:

Violates any law or promotes illegal activities
Contains hate speech, discrimination, or promotes violence against individuals or groups
Is fraudulent, deceptive, or designed to mislead others (including phishing, spam, or malware distribution)
Infringes copyrights, trademarks, rights of publicity, privacy rights, or other intellectual property or proprietary rights
Depicts real individuals without their consent, especially for harmful or misleading purposes
Harasses, threatens, or bullies any person
Contains explicit sexual content involving minors or any exploitation of minors
Spreads misinformation or disinformation intended to cause harm

You also agree not to:

Attempt to bypass usage limits, rate limits, or other technical restrictions
Use automated scripts, bots, or other tools to abuse the Service
Interfere with service operations, security, or other users' access
Reverse engineer, decompile, or attempt to extract the source code of the Service

Enforcement: We reserve the right to suspend or terminate accounts that violate these Terms, with or without prior notice, and without refund where permitted by law.

10. AI Output Disclaimer

AI-generated videos may be inaccurate, unexpected, or unsuitable for your intended use.
Outputs may vary based on text prompts, reference images, duration settings, sound settings, and system conditions.
We do not guarantee any specific quality, accuracy, or fitness for a particular purpose.
You are solely responsible for reviewing and verifying outputs before use.

11. Privacy

Our data practices are described in our Privacy Policy. By using the Service, you consent to those practices.

12. Service Availability and Changes

We aim to keep the Service available but do not guarantee uninterrupted operation.
We may modify, suspend, or discontinue features, limits, or the Service at any time, including for maintenance, security, or business reasons.
We will make reasonable efforts to provide advance notice of significant changes.

13. Termination

You may stop using the Service at any time.
We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses risk to the Service or others.
Upon termination, your right to use the Service ends immediately.
We may retain certain information as required by law or for legitimate business purposes.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY PARTICULAR OUTPUT QUALITY, ACCURACY, OR RESULT.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NANO-BANANA.VIDEO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

16. Indemnification

You agree to indemnify and hold harmless nano-banana.video and its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of:

Your use of the Service
Your violation of these Terms
Your violation of any law or third-party rights
Content you submit or generate through the Service
